Liability Waiver

By participating in any classes or programs offered by Art of Performance through Hayley-Lewis.com, you agree to the following:

1. Assumption of Risk: As a participant, I may elect to participate in classes offered by Art of Performance, including but not limited to dance, performing, exercise, fitness, yoga, health, and more. I understand that these classes may involve strenuous physical activity and exertion, which could be difficult, draining, or aggravate existing physical conditions. I assume full responsibility for the risks and hazards associated with such participation.

2. Medical Consultation: I understand that it is my responsibility to consult with a physician before participating in any program or class to ensure I am physically fit and have no medical conditions that would prevent me from full participation.

3. Personal Responsibility: I agree to assume all responsibility for any injuries, medical conditions, or damages, known or unknown, that may occur due to my participation in these programs.

4. Waiver of Claims: In consideration of being allowed to participate in these programs, I knowingly and voluntarily waive any claims I may have against Art of Performance, its staff, contractors, or teachers for any injuries, conditions, or damages that may result from my participation.

5. Release of Liability: I release Art of Performance and its associated staff from all liability for any injury, condition, or death that may occur due to my participation in these programs and waive all rights to legal action.

6. Ongoing Health Information: I understand that I must inform the instructor of any medical conditions, injuries, or surgeries prior to my first class and as necessary thereafter.

7. Physical Adjustments: I acknowledge that teachers may make physical adjustments during in-person classes. It is my responsibility to inform the instructor if I prefer not to be touched or adjusted.

8. Pregnancy: If I am pregnant or may become pregnant, I understand it is my responsibility to consult my physician prior to participation.

9. No Claim for Refusal: I understand that if Art of Performance refuses to allow me to participate in any class, I will have no claims against them other than a possible monetary refund.

10. Filming and Photography: I understand that I may be filmed or photographed during classes for security or promotional purposes. These images or videos may be used on the website, in marketing materials, or for other promotional purposes.

11. Right to Refuse Entry: Art of Performance reserves the right to refuse entry to any class for any reason.

Cancellation Policy

1. Art of Performance:

Reservation cancellations must be submitted via email to hayleyllewis1@gmail.com.
Cancellations made up to twenty-four (24) hours before a scheduled appointment will be processed without penalty. In this case, you will receive either a full refund or class credit.
Cancellations made twenty-four (24) hours or less before the scheduled appointment are subject to no refunds.

2. If we (Art of Performance) cancel your appointment within less than twenty-four (24) hours, we will work with you to reschedule your appointment at no additional cost, subject to availability.

3. Hayley Lewis Photography:

A non-refundable deposit of 25% of the total payment is required at the time of booking the photoshoot.
The remaining balance is due on the day of the photoshoot.
Extreme Weather Conditions: In the event of extreme weather conditions (e.g., severe storms, flooding, snow, or other hazardous weather), Hayley Lewis Photography will reschedule the photoshoot at no additional charge.
Clients will be notified as soon as possible in cases of rescheduling due to weather, and a new appointment will be arranged at the earliest availability.

Please ensure that cancellations and any rescheduling requests are made within the specified timeframes to avoid any charges or penalties. If you have any questions regarding this policy, feel free to reach out via email at hayleyllewis1@gmail.com.

6. Stock Images

We may use stock images on our website to enhance the visual experience. All stock images are used in accordance with applicable licensing agreements. Users are prohibited from reproducing, distributing, or using these images for commercial purposes without explicit permission.While we strive to ensure that all stock images are properly licensed, we cannot guarantee against copyright infringement. We are not liable for any claims arising from the improper use of stock images.Attribution may be required for certain images, and it will be specified where applicable. We reserve the right to update our stock image usage policy and will notify users of any changes.
